The No Surprises Act & ERISA's Broker Compensation Disclosure Rules

This 2-hour credit course provides instruction on several issues arising under the Consolidated Appropriations Act of 2021, which was primarily enacted to provide COVID-19 pandemic relief but also contains the No Surprises Act (the “Act”) and provisions to heighten the compensation disclosure requirements for employee benefits service providers. Under the Act, providers are prohibited from balance billing members for emergency services, services provided by in-network facilities at out of network facilities and out of network air ambulance bills. Instead, providers are only entitled to the Qualifying Payment Amount (QPA) for those services. In the event the QPA is disputed by the plan and the provider, Independent Dispute Resolution (IDR) is required.  Additionally, the legislation extended the service provider ERISA compensation disclosure requirements that apply to retirement plans to health and welfare plans.

COBRA and the FMLA: What You Need to Know

This 2-hour credit course provides instruction on the Consolidated Omnibus Budget Reconciliation Act of 1985 (“COBRA”) that requires sponsors of most group health plans to offer employees and their families the opportunity to receive continued health coverage after termination of employee. The Family Medical Leave Act (“FMLA”) entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons with continuation of group health insurance coverage under the same terms and conditions as if the employee had not taken leave. This course, which is intended to be participatory by students, will provide practical information regarding COBRA and the FMLA regulatory requirements to enable students to better serve their clients and function more efficiently as a member of the employee benefits industry. Although the information covered is technical in nature, the course instruction will be delivered in an easily understood manner. Throughout the session, students are encouraged to share their experiences with the topics covered with the goal of also facilitating peer-to-peer education.
